I am peculiar if a person has to be only on the loan, or title, or both, if they are making the loan payments to be proper for the mortgage interest tax deduction write off.
Answer: You have to be on the mortgage and in categorize to be on the mortgage, you have to be on the title.

In Texas, if I buy mineral rights from a homeowner who has an existing mortgage then he defaults on his mortgage and loses his oddity in foreclosure, do I also lose my mineral rights? Can I redeem my mineral rights? What are my options in this species
Answer: In general if he has a mortgage in place, and THEN conveys the mineral rights, without having the lender be contiguous in, and the property is foreclosed, you are IMHO out of luck. The mineral rights would be excuse to the mortgage.
